In December 2023, the UK Parliament passed “Awaab’s Law” — a landmark piece of legislation named in memory of two-year-old Awaab Ishak, who tragically died in 2020 from a respiratory condition caused by prolonged exposure to mould in his family’s social housing flat in Rochdale. His death was a devastating wake-up call — not just for social housing providers, but for all landlords across the private and public sectors. Awaab’s Law now mandates that social housing landlords in England must investigate and fix reported damp and mould hazards within strict timeframes — typically no more than 14 days to inspect, and further action required promptly if hazards are confirmed.
Why This Law Matters
Awaab’s Law isn’t just about compliance — it’s about compassion, accountability, and prevention. For too long, damp and mould were dismissed as “cosmetic issues” or tenant-caused problems. But science and now the law confirm: unchecked mould is a serious health hazard, especially for children, the elderly, and those with respiratory conditions. Under this new legislation, landlords who fail to act risk enforcement notices, financial penalties, and even prosecution.
Beyond legal obligations, Awaab’s Law is a moral imperative. No family should live in fear of their home making them sick. Proactive mould remediation, proper ventilation (like PIV systems and extractor fans), and swift response protocols aren’t just best practices — they’re now the baseline standard.
What Landlords Must Do Now
Respond Quickly — Any tenant report of damp or mould must trigger an inspection within 14 days.
Remediate Thoroughly — Surface cleaning isn’t enough. Address the root cause: poor ventilation, leaks, or insulation gaps.
Prevent Recurrence — Install long-term solutions like Positive Input Ventilation units and high-performance extractor fans to control humidity and airflow.
Document Everything — Keep clear records of inspections, communications, and remediation work to demonstrate compliance.
Awaab’s Law transforms landlord responsibilities — but it also offers an opportunity. By embracing this change, landlords can protect tenants’ health, avoid costly legal action, reduce void periods, and enhance their reputation as responsible, caring property stewards.
Let Awaab’s legacy be safer, healthier homes for everyone. Don’t wait for a complaint — invest in prevention today.
Please note that Awaab’s Law only applies to social housing and homes provided via the local council.
